LESSON DESCRIPTION

Objectives

The continuing objectives of the Police Law Institute’s lessons are to help officers:

• increase their enforcement effectiveness and efficiency and

• increase their safety by reducing the physical and financial dangers.

 

Topics

This Legal Update & ReviewTM analyzes United States and Illinois case law related to:

• landlord-tenant disputes, and

• entries and searches of rooms in hotels and motels. 

 

The material reviews important legal principles and discusses how you can enforce the law effectively and safely. These principles can be applied during investigations conducted by officers who are in either uniform or plainclothes and when investigating all crimes and criminal ordinance violations. 

 

Landlord-Tenant Disputes — Investigating Complaints

Landlords and tenants often have opposing views regarding their respective rights and responsibilities. When they disagree, tempers may flare and violence is a possibility. It’s often difficult to determine the legal relationship of the parties. This section reviews pertinent Illinois law regarding landlord-tenant disputes.

 

It will examine:

• long-term rental agreements for apartments and houses, and 

• shorter-term agreements that apply to hotels and motels.

 

Recommendations are made for:

• investigating disputes or criminal activity, and 

• determining when enforcement action is appropriate. 

 

Entering and Searching Hotel and Motel Rooms

This section reviews Federal and Illinois law governing criminal investigations involving lodging establishments. 

 

Recommendations are made for ensuring:

• the legality of your entries into hotel and motel rooms, and 

that your observations and discovered evidence will be admissible in court.
