COURSE CONTENT: At the end of the day, students will understand:

Use of Overhear Recording Devices

How to obtain and document State’s Attorney’s Authorization

What information an officer may disclose from an overhear to other police officers

How to document and obtain Judicial Approval of Use of Eavesdropping Device

How to document and obtain grounds for approval or authorization

How to document and obtain an Order authorizing use of eavesdropping device

The emergency exceptions to procedures and all sections of 725 ILCS 108

How long the recordings will be held

When notice must be made to the parties overheard

What equipment is needed for an overhear

The importance of time and how to address that to the non-consensual party

Participants will listen to portions of actual overhears that led to successful prosecutions

Search Warrant Preparation

How to prepare Affidavits/Complaints

How to prepare Search Warrants

How best to document the probable cause in the Affidavit/Complaint

How to prepare Search Warrant Returns

Students must bring a USB drive to obtain digital copies of sample documents

Resources:

Overhears- Copies of all required documents (application, consent, State’s Attorney’s authorization order and return) will be available in hard copies as well as electronic version, if a thumb drive is provided.

Search Warrants- Examples will be provided to search, residence, suspects body, vehicle trackers, phones, and laptops.

Instructor:

Jeffrey Kline served 28 years with the Illinois State Police, where he was assigned as a Special Agent on the FBI Joint Terrorism Task Force from 2004 to 2009 and the General Criminal Investigations Unit in Zone 7 (Effingham) from 2009 until his retirement in 2018.

As an Investigator he wrote numerous applications and orders for Eavesdropping. These cases covered in these orders included Aggravated Criminal Sexual Assault, Arson and Murder for Hire. Jeffrey also holds an Electronic Criminal Surveillance Officer I Certificate from the Illinois State Police Academy in Springfield.
