Overview of the Act’s provisions

  • Effective date
  • Public policy declaration
  • What prohibitions the Act continues to allow with regard to the use of “recreational marijuana”
  • Changes that the Act makes applicable to the use of “recreational marijuana”,  (including amendments to the Illinois Right to Privacy in the Workplace Act)
  • Conflicts between Illinois and Federal law with respect to “recreational marijuana”

How does the Act impact the employment relationship?

  • Expungement of criminal records and the hiring process
  • “Zero tolerance” policies – are they allowed under the Act?
  • Drug testing policies after January 1, 2020
  • Disciplinary policies and practices following the Act’s effective date
