In 1986, the Occupational Safety and Health Administration (OSHA) adopted a regulation that requires employers to protect any employee who may face exposure to hazardous materials.

Over time, OSHA has expanded and refined the regulation (standard 29 CFR 1910.120) to include highly specific training that provides such employees with a copy of the regulation itself, and a thorough explanation of its contents. „¯

Four Levels of Hazmat Training. Law enforcement officers are required by OSHA to complete hazmat training. The amount and depth of training depends on how often an officer is likely to face hazmat exposures, as well as their role in dealing with them.

The four levels of training are:

• Awareness – recognizing when threats exist, and when to call in specialized help.

• Operations – responding defensively and containing a threat by limiting public exposure.

• Technician – approaching the point of release to engage the threat and help stop it.

• Specialist – this can include law enforcement officers who work in laboratories or on bomb squads. „¯

The HAZWOPER Rule. Federal regulation CFR1910.120 is more commonly known as the HAZWOPER rule (Hazardous Waste Operations and Emergency Response). It mandates that law enforcement officials be trained at the awareness level (Level 1).  „¯

Training Compliance. OSHA requires that employers provide this training free of charge to anyone at risk of occupational exposure to hazardous materials. All hours devoted to hazmat training are paid work hours.
